Terms of Service

Please read these terms carefully before using New Heits Fitness services.

These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Client") and New Heits Fitness LLC ("New Heits Fitness," "we," "us," or "our"), the company that operates this website and provides online and in-person fitness and nutrition coaching led by Jonathan Heitritter. By accessing our website or using any of our services, you agree to these Terms in full.

01 Agreement to Terms

By visiting newheitsfitness.com, booking a call, enrolling in a program, or otherwise using any service we offer, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the website or our services.

These Terms apply to every visitor and every Client. They cover the website, free resources, paid coaching, digital content, and any communication or transaction between you and New Heits Fitness.

02 Services & Pricing

New Heits Fitness provides fitness and nutrition coaching designed to help motivated people build sustainable habits and reach their goals. Here's our offer ladder and what each option costs:

  • 5-Day Challenge CourseFREE. A short-format program to help you build momentum and learn our approach.
  • Fitness Consultation CallFREE. A complimentary call where we discuss your goals and outline a recommended path. No obligation to purchase.
  • Month-to-Month Coaching$400/month. Ongoing coaching billed monthly, cancel anytime.
  • 3-Month Program$600/month, or $1,500 paid in full.
  • 6-Month Program$500/month, or $2,400 paid in full.
  • 24/7 Text Support — included with all coaching packages.
  • Trainerize app access — included on the 3-month and 6-month packages.

Every coaching package includes 24/7 text support, customized workouts, nutrition plans, calorie/macro updates as you progress, and comprehensive check-ins. Everything is delivered digitally — by email, text, and (on the 3-month and 6-month packages) the Trainerize app. You'll get initial access within 24–48 hours of payment, and your custom plans within 3–5 business days.

We may update, improve, add, or discontinue specific services or features at any time. The exact scope, duration, and deliverables of any paid engagement will be confirmed at the time you enroll.

03 Eligibility

You must be at least 13 years old to use New Heits Fitness services. If you are between 13 and 17, you may only participate with the consent and active supervision of a parent or legal guardian who agrees to these Terms on your behalf. If you are 18 or older, you may enroll on your own. By using our services, you represent that you (or your parent/guardian, if you're a minor) are legally able to enter into a binding contract and that all information you provide is accurate.

04 Health Disclaimer & Assumption of Risk

Important — read this before starting any program. New Heits Fitness provides fitness and nutrition coaching for general wellness and education purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for the guidance of a licensed physician or other qualified healthcare provider. Consult your physician before beginning any exercise or nutrition program, especially if you have or suspect any medical condition, injury, or are pregnant.

By participating, you acknowledge and agree that:

  • Exercise carries an inherent risk of injury, and you participate voluntarily and at your own risk.
  • You represent that you are physically able to participate in the activities recommended and have no medical condition that would make participation unsafe.
  • You assume full responsibility for any risks, injuries, or damages, known or unknown, that may result from your participation.
  • To the fullest extent permitted by law, New Heits Fitness LLC and Jonathan Heitritter are not liable for any injury, illness, or harm arising from your use of our programs, content, or guidance.

Stop any activity and seek medical attention immediately if you experience pain, dizziness, or discomfort.

05 No Guarantee of Results

Individual results vary. Your outcomes depend on factors we do not control — including your effort, consistency, genetics, starting point, lifestyle, and adherence to your plan. Any testimonials, before-and-after examples, or results shown on our website or in our communications reflect specific individuals and are not a promise or guarantee that you will achieve the same or similar results. We make no warranty, express or implied, regarding any specific outcome.

06 Payments & Billing

Paid programs are billed through our third-party payment processor, Stripe. By purchasing, you authorize us (and Stripe) to charge your selected payment method for the agreed amount, including any applicable taxes.

  • One-time payments are charged in full at the time of purchase.
  • Recurring or subscription plans renew automatically at the stated interval (for example, monthly) until you cancel. By enrolling in a recurring plan, you authorize ongoing charges until cancellation.
  • You are responsible for keeping your payment information current. Failed or declined payments may result in suspension of access until resolved.

We do not store your full card details — payment data is handled securely by Stripe under their terms.

07 Refunds & Cancellations

The free 5-Day Challenge and the free consultation carry no charge and no obligation — there's nothing to refund or cancel for those.

For paid coaching, here's how it works:

  • Month-to-month coaching — cancel anytime. You keep access through the end of the month you've already paid for, and you won't be billed again. We don't offer partial-month refunds.
  • Pay-in-full programs (3-month at $1,500 / 6-month at $2,400) — if you request it in writing, we'll prorate a refund for any full months you haven't used yet, minus the value of any free bonus already delivered. Digital materials that have already been delivered are non-refundable.
  • Digital content — once digital materials or program content have been delivered or accessed, they are non-refundable.

To cancel or reschedule coaching or a call, contact Jonathan with at least 24 hours' notice. To request a refund, email info@newheitsfitness.com with your name and order details and we'll respond promptly. All payments are processed securely via Stripe. If anything is unclear before you buy, ask us first — we'd rather set expectations up front.

08 Client Responsibilities

To get the most out of coaching and to keep it safe, you agree to:

  • Provide accurate, complete, and current information about yourself, your goals, and your circumstances.
  • Disclose relevant health information honestly, including injuries, conditions, medications, and limitations.
  • Follow guidance responsibly, use good judgment, and not exceed your capabilities.
  • Attend calls and sessions you've booked, and give reasonable notice if you need to reschedule.
  • Communicate openly with your coach so your program can be adjusted as needed.

09 Intellectual Property

All programs, training plans, nutrition materials, videos, written content, branding, and other materials we provide are the intellectual property of New Heits Fitness LLC and are protected by applicable law. When you enroll, you receive a personal, limited, non-transferable license to access and use those materials for your own personal use only.

You may not copy, reproduce, resell, redistribute, publish, or share our materials with others, post them publicly, or use them to create competing products or services, without our prior written permission.

10 Third-Party Services

We rely on trusted third-party platforms to deliver our services, which may include GoHighLevel (CRM, scheduling, and communications), Stripe (payments), Trainerize (training and nutrition delivery), Loom (video content), and various scheduling and calendar tools. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for the practices, availability, or content of third-party services. 11 Communications Consent

By submitting a form, booking a call, or otherwise providing your contact information, you consent to receive communications from New Heits Fitness by email, SMS/text message, and phone — including follow-up, scheduling, program, and (where permitted) promotional messages. Message and data rates may apply.

You can opt out of marketing communications at any time by replying STOP to texts, using the unsubscribe link in emails, or emailing info@newheitsfitness.com. We may still send essential service messages related to your account or active coaching. For details on how we collect and use your information, see our Privacy Policy.

12 Limitation of Liability

To the maximum extent permitted by law, New Heits Fitness LLC, Jonathan Heitritter, and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of our website, services, programs, or content. To the extent any liability is found, our total aggregate liability to you shall not exceed the total amount you actually paid to us for the services giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13 Indemnification

You agree to indemnify, defend, and hold harmless New Heits Fitness LLC, Jonathan Heitritter, and our affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any law or the rights of any third party.

14 Termination

Either you or New Heits Fitness may end the coaching relationship. You may stop participating or cancel future renewals at any time as described above. We may suspend or terminate your access if you violate these Terms, fail to make payment, or engage in conduct that is abusive, unsafe, or harmful to us, our staff, or other clients. Upon termination, your license to use our materials ends, and any provisions that by their nature should survive (including disclaimers, limitations of liability, and intellectual property terms) will continue to apply.

15 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Iowa, USA, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Iowa.

16 Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, technology, or the law. When we do, we'll revise the "Last updated" date above. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
